End User License Agreement (EULA)

1. Acknowledgement
This EULA is a legal agreement between you (the "End-User") and us (the Application Provider) only, and not with Apple Inc. or Google LLC. We, not Apple or Google, are solely responsible for the Application and its content. This EULA does not conflict with the Apple Media Services Terms and Conditions or Google Play Terms of Service; if there is a conflict, those terms prevail to the extent of the inconsistency.
2. Scope of license
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the Application:
- on any Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions (including Family Sharing or volume purchasing where applicable); and
- on any Android device you own or control, as permitted by the Google Play Terms of Service,
solely for your personal, non-commercial use. You may not rent, lease, lend, sell, redistribute, sublicense, copy (except as permitted by law), modify, reverse engineer, decompile, or disassemble the Application, except where applicable law prohibits these restrictions.
3. Maintenance and support
We are solely responsible for maintenance and support as we specify or as required by applicable law. Apple and Google have no obligation to provide maintenance or support for the Application. For support, contact hello@threadtheword.com.
4. Warranty
We are solely responsible for product warranties to the extent not effectively disclaimed under applicable law.
For App Store users: if the Application fails to conform to an applicable warranty, you may notify Apple; Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation. Any other claims relating to failure to conform to warranty are our sole responsibility.
Disclaimer: EXCEPT AS REQUIRED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. Some states do not allow exclusion of implied warranties; in those states, the above may not fully apply.
5. Product claims
We, not Apple or Google, are responsible for addressing claims relating to the Application or your possession or use of it, including: (i) product liability claims; (ii) claims that the Application fails to conform to legal or regulatory requirements; and (iii) claims under consumer protection, privacy, or similar laws. This EULA does not limit liability beyond what applicable law permits.
6. Intellectual property rights
We, not Apple or Google, are solely responsible for investigating, defending, settling, and discharging any claim that the Application or your use infringes a third party's intellectual property rights. The Application and all rights in it remain owned by us and our licensors.
7. Legal compliance
You represent and warrant that: (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

9. Third-party terms
You must comply with applicable third-party terms when using the Application (for example, your wireless data service agreement). You are responsible for carrier or data charges.
10. Third-party beneficiary (Apple)
You and we acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
11. Privacy
Our collection and use of personal information is governed by our Privacy Policy at https://babynamefinder.threadtheword.com/privacy, which is part of the terms applying to your use of the Application.
12. Termination
This license is effective until terminated. Your rights terminate automatically if you fail to comply with this EULA. On termination, stop all use of the Application and delete all copies. You may also terminate by deleting your account in the App (Edit Parents Profile -> Delete Account) or uninstalling the Application.
13. Governing law
This EULA is governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law rules, except where the laws of your state of residence provide non-waivable consumer protections.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APPLICATION. OUR TOTAL LIABILITY SHALL NOT EXCEED USD $100 OR THE AMOUNT YOU PAID FOR THE APPLICATION IN THE PRIOR TWELVE (12) MONTHS, IF ANY. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
15. Changes to this EULA
We may update this EULA from time to time. We will post the updated version at https://babynamefinder.threadtheword.com/eula and update the "Last updated" date. Continued use after changes take effect means you accept the updated EULA.
